Because, at the time, they likely couldn't get the licensing for Mercedes-Benz products, so they went to Brabus for their versions which were, in theory, modified and trademarked as such that they could be licensed without Daimler's approval, because, unlike AMG, Brabus is an independent tuner, not an affiliate of the OEM.

There were many games that licensed M-Bs from 2003 to 2005, but not every game that had licensed cars had licensed M-Bs, likely because at the time, Daimler was probably selective on who could license their products, which would explain why mainly the major titles, like PGR, Gran Tursimo, Forza, Midnight Club, and Need For Speed had licensed M-Bs, but smaller studio titles didn't.

In fact, I don't think we'd see a 'smaller' studio title get licensed production M-Bs until Test Drive Unlimited.

No, it's a Brabus. Brabus' modifications to the W168 were rather minimal on the outside, as seen in this image that has all of the parts added to a stock W168 to make it a Brabus...

...the wheels and bumpers are the only cosmetic changes on the outside of a Brabus W168, and this was from before Brabus actually replaced the three-pointed star with their own 'B' emblems.

Ok, just a quick little bit back to the Minecraft thing...I just discovered something rather conflicting.

Noxcrew recently released their new 'World of Cars' add-on, and it's got over 40 vehicles and a big map, unfortunately it seems that some are reused from previous Noxcrew addons, Millionaire Mansions 2 and City Living, but with new names.

If they were allowed to be listed, what would the way to go about it be? Would they not be listed with a surname, instead having the surnames from the various add-ons listed in a comment?
